How does a Virginia closing work?

Virginia closings run through a settlement agent, either an attorney or a licensed title company, and that agent handles both sides of the table. You don’t need your own attorney to sell, though you’re welcome to have one review the contract.

From there it’s short:

  1. You sign. At a local title office, or remotely if you’ve already left the state.
  2. The money moves. Funds are wired to you the day of closing. No lender is underwriting the deal, so there’s nothing left to fall through.
  3. The keys change hands on your date. A week out or a few months out, and if you need to stay in the house a while after closing, that can usually be arranged.

Do I have to disclose problems with the house?

Only what you already know. Under Virginia’s Residential Property Disclosure Act you have to tell a buyer about material defects you’re aware of, but the state doesn’t require you to go investigate, inspect, or warrant anything you don’t.
